HOMEOWNERS – SHORT TERM RENTAL LAW

Key Features of the New Rental Law

v  Takes Effect July 1, 2019 on units leased after January 1, 2019

v  Homeowners must register their properties with the MA Department of Revenue

v  They must collect a state lodging tax of 5.7% to short-term rentals, along with any applicable city, town or regional (Cape Cod) taxes

v  Requires property owners to carry liability insurance of at least 1 million for each short-term rental.

v  Exempts properties rented for less than 14 days per year from taxation, but they still must be registered and insured.

Short Term Rentals (Airbnb,Vrbo etc.) – *NEW MASSACHUSETTS LAW*

Although the law doesn’t take effect until July1, 2019, it applies to booking being made NOW (since January 1, 2019) for stays on or after July 1, 2019.  Mass implemented a law to address a rental tax bill and new insurance requirement.  If you are operating short term rentals on any properties we insure, please contact us as soon as possible as additional coverage is needed to be properly covered.  Please see attached notice on key features of the new rental law.

Homeowner’s who rent for 14 days or less per year can apply for an exemption from taxes, but they are still required to register and insure the property.
